SCOTUS Ends CDC Moratorium

On August 26th, 2021 the Supreme Court of The United States (SCOTUS) ended the most recently imposed CDC Eviction Moratorium. You can review the ruling here. SCOTUS reiterated in the notice that any further impositions of a moratorium must be passed legislatively through Congress.

As we have recommended for many months, renters facing COVID-related financial hardships should communicate with their apartment management or landlord, and urgently pursue available Emergency Rent Assistance Program (ERAP) funds. Millions of dollars in emergency rental assistance funds are available through the OUR Florida program, and at the local level via the City of Orlando, Orange County, Osceola County, Lake County, Seminole County, and Volusia County.

Housing providers are encouraged to consult with internal and/or landlord-tenant counsel prior to making any procedural or operational changes in the wake of this SCOTUS ruling.
