Rules surrounding children, occupancy limits, and shared community spaces can create challenging situations for multifamily professionals. From pool rules and playground supervision to noise complaints and occupancy standards, it is important to understand how community policies intersect with Fair Housing requirements. This session will explore familial status protections, reasonable occupancy standards, and the development and enforcement of community rules. Participants will learn how to address resident concerns, apply policies consistently, and maintain a welcoming community without unintentionally discriminating against families with children.

Key Takeaways

  • Understand familial status protections under the Fair Housing Act and how they apply to everyday property management decisions.

  • Identify community rules involving children, pools, amenities, and common areas that may create Fair Housing concerns.

  • Understand factors to consider when establishing and applying reasonable occupancy standards.

  • Recognize the difference between legitimate health and safety requirements and rules that may unfairly restrict families with children.

  • Develop strategies for responding to noise complaints, resident disputes, and concerns involving children without applying policies inconsistently.

  • Identify potential Fair Housing risks and determine when additional review or legal guidance may be necessary.
